What is BOCW Act (Building and Other Construction Workers Act 1996) :

In fact, building and other construction workers are the most vulnerable. Their work is also temporary and the working hours are very long. Therefore, to protect their interests, the Central Government had enacted the “Building and Other Construction Workers Act 1996” (BOCW Act). Under this Act, “BOCW Welfare Boards” have been formed in all the states.

According to this act, any construction work that costs more than Rs. 10 lakh, one percent of its total cost has to be deposited under the Building and Other Construction Workers act (BOCW Act). Which has to be spent for the welfare of construction workers through 18 schemes.

The Act provides for the employment and service conditions of building and other construction workers as well as their safety, health and welfare measures. Under this, masons, bricklayers, plumbers, welders, electricians, sewerage, marble, tile installers and painter-POP etc. are included.

Workers engaged in building and other construction work who come under the category of unorganized workers, their condition is extremely weak and pathetic due to working in hazardous conditions, temporary and irregular employment, uncertain working hours, lack of basic and welfare facilities etc. Due to the absence of adequate legal provisions, it was a rare task to get accurate information about workers’ accidents, fix responsibility and implement corrective measures. Therefore, the need for a comprehensive central legislation was felt to streamline the safety, welfare and other service conditions of the workers.

The Building and Other Construction Workers (Employment and Terms of Service) Act, 1996 (BOCW Act) has been created by the Government of India to streamline the employment and service conditions, safety, health and welfare measures of the workers.

Where does the BOCW Act apply? 

Friends, let us inform you that the then central government had brought the BOCW act in 1996, 28 years ago. This BOCW Act is applicable to all those establishments, which are registered under the Factory Act.  Where construction work is going on.

Eligibility for registration with BOCW Welfare Board under BOCW Act

Friends, now let us inform you that what is the eligibility required for registration in BOCW Welfare Board?  Its details are as follows.

  • Applicant should be a citizen of India.
  • The age of the applicant should be minimum 18 years to maximum 60 years.
  • The applicant must have worked as a construction worker for at least 90 days i.e. three months.

Documents required for registration in BOCW Welfare Board

The documents required for registration in BOCW Welfare Board are as follows

  • Employment certificate/self declaration of construction worker.
  • Photocopy of Aadhaar card of the applicant.
  • Bank passbook of the applicant.
  • Two passport size photographs of the construction worker.
  • Age certificate of the applicant (any of these documents) –
  • Voter ID Card,
  • Ration Card,
  • Certificate issued by Gram Panchayat Officer / Village Head / Councillor,
  • Records obtained from school, Certificate obtained from Registrar of Birth and Death,
  • Certificate from a Medical Officer, Affidavit of Construction Worker attested by Notary

How can registration be done in BOCW Board?

Registration in BOCW Board can be done through Jan Suvidha Kendra.  Apart from this, if you wish, you can also register yourself online through the portal of the BOCW Welfare Board of the state in which you are living.  Let us know the process of registration, which is as follows –

  • Step 1 :- Visit the nearest public service center with all your necessary documents like Aadhaar card, date of birth certificate, employer certificate and passport size photo.
  • Step 2 :- Here the operator will scan and upload your documents by filling your form online.
  • Step 3 :- Once all the information is submitted and documents are uploaded, your registration process will be complete.
  • Step 4 :- A receipt will be generated after the registration is complete.  Download it.
  • Step 5 :- You can take a print of it and keep it safe with you for future reference and to know the status of your application.
